Condominio negli edifici: facoltà di sopraelevare e nullità della transazione non unanime

CORTE DI CASSAZIONE - SEZIONE SECONDA CIVILE - SENTENZA 24-02-2006, n. 4258
La facoltà di sopraelevare concessa dall'art. 1127 c.c., comma 1, al proprietario dell'ultimo piano dell'edificio condominiale, ove l'ultimo piano appartenga, pro diviso a più proprietari, spetta a ciascuno di essi nei limiti della propria porzione di piano con utilizzazione dellospazio aereo sovrastante a ciascuna porzione e nel rispetto dei limiti di cui all'art. 1127 c.c., comma 2 e 3. La Corte di Cassazione ha inoltre stabilito che la transazione avente ad oggetto i beni comuni è un negozio dispositivo, e pertanto per essere validamente conclusa dall’amministratore richiede il consenso di tutti i condomini.
